Permanent Residency - Renewing TIE After 5 Years – Withdrawal Agreement

Hi everyone,

I know this topic comes up a lot but reading the threads there seems to be different experiences and conflicting info online.

I’m a British citizen who obtained Spanish residency pre-Brexit (October 2019), so I fall under the Withdrawal Agreement. I exchanged my green residency paper for the TIE in 2020 as recommended, and my TIE expires in April 2025.

Since I have now been a resident for over 5 years, I understand that I am entitled to permanent residency automatically under the Withdrawal Agreement. However, I have some questions about the renewal process:

1️⃣ Which forms do I need to fill out? Do I need to take new photos and bring them etc. Do I pay at the bank again of 12 euros?

2️⃣ What type of appointment(s) should I book or arrange via my gestor? I will of course ask their expertise but my main gestor is in tax advice not immigration etc.

3️⃣ How long does the process take, and when should I start?

4️⃣ Do I need to provide proof of residency (tax records, padrón, social security, etc.), or is my right to permanent residency automatic? I have only been outside of Spain a few weeks here and there per year on holidays.

5️⃣ Do I need to request that my new TIE states that I am covered under the Withdrawal Agreement, or is this automatically included?

I am based in Valencia, so I would really appreciate hearing from anyone who has recently gone through this process in this region or is in a similar situation under the Withdrawal Agreement.

Thanks in advance for any guidance or shared experiences on what to expect when going to these appointments. Also would I have to go to immigration in Alicante or local police station in Valencia?!

I am based in Valencia, so I would really appreciate hearing from anyone who has recently gone through this process in this region or is in a similar situation under the Withdrawal Agreement.
Since nobody will have actually been through the process yet the first hand information you seek does not yet exist.

The earliest you can start the process is 60 days before the TIE expiry date, when you actually became resident is irrelevent as the first TIE is valid for 5 years for all.

When the time does come if you have a Digital Certificate supposedly you will be able to renew online as per the following. I suspect the system will automatically reject premature applications.

Go to the following webpage Extranjería - Administraciones Públicas

Click on 'MERCURIO – Renovación de Autorizaciones de Extranjería – Presentación Telemática' to enter the online portal.

The information on the next page tells you what processes you can do through the portal. Scroll all the way to the bottom of the screen and click the button that says
'Acceder al Procedimiento a solicitudes telemáticas de autorizaciones de extranjería' or Access the Procedure.

On the next page you see, simply click on Continuar or Continue.

If you are filling out the form yourself, click on Acceso Individual, and then Continuar Individual This will automatically bring up your digital certificate so you can officially be identified online.

Once it’s validated click on Continuar presentación followed by 'Presentar renovación/Obtener resguardo renovación' or Submit renewal/Obtain a receipt of renewal.

Click on Aceptar (Accept) to bring you to the next page where you’ll fill out your personal details including NIE number, nationality, date of expiry of your current card and date of birth.

You will then check all your data is correct including the type of visa you have and click on Conforme.

The next page will bring up all the personal data the system has for you - complete any boxes that are empty or missing.

Next add your address where you want to be notified and then click on CONSIENTO que las comunicaciones y notificaciones se realicen por medios electrónicos to show that you agree for your details to be sent electronically.

On the next screen click on Presentación de la solicitud de forma electrónica: 'PRESENTACIÓN ELECTRÓNICA' to show that you want to send it online.

A pop-up will appear asking you to confirm that you are legally in Spain. Check the box and click Aceptar.

Next you will need to upload all your supporting documents, which you can find below. It’s best if you put them all into a pdf, .doc or similar so you only have to upload one document, but you can do more than one if needed.

Once you have uploaded them all, click on Documentación completa or Documentation complete.

For the next step you will need to install the Autofirma tool on your computer to sign the form electronically. If you don’t have it you can download it here Portal Firma - Descargas

Click on 'Firmar y Registrar' to sign your renewal application and send it all. Download a copy of it by clicking on ‘Descargar’.

Once you’ve sent it you can log on at a late date to see the status of your application here following website: DEHú.

If need be the authorities may ask you to submit extra documents. Simply click on 'Aportar documentos a expedientes' or Submit documents to an existing fil

What documents do I need to renew my TIE

  • Original and a photocopy of your passport
  • Expired TIE
  • Three recent colour passport photos
  • Completed renewal form
  • Renewed visa approval
  • Tax form 790 to pay the fee
  • Social security certificate or
  • Private medical insurance
  • Empadronamiento certificate
Be aware that they may ask for extra documents depending on your situation. Some of these may change depending on if you’re going in person or submitting online too.

Im just going to give the job to our solicitor as she has our digital cert... If we dont have to head to Alicante a couple of times then its a win for me would rather do it online..

The renewal for the TIE if you are on the NLV requires you to do the whole thing again, two visits, fingerprints in person not online. As a couple of friends of ours have recently been through it.
I would assume that you will have to appear in person to collect the new TIE and press the fingerprint machine.
Hopefully Benidorm will have appointments this time.

I have recently received my permanent residency (albeit not under the withdrawal agreement). There were three visits to the National Police:
1. Turn in all the documents and pay fee.
2. Do the fingerprints.
3. Turn in old TIE and receive new card (along with fingerprints again).

It took 5 weeks from turning in the documents to be notified of approval thru the online system. It then took 2 months from that time for the fingerprints! Six weeks after the fingerprints, I was able to pick up new card. I was surprised how long it took after approval to actually get my new card.
