Hi ,
I am in work visa to PR situation for tax purpose

From July 01,2012 to April 21, 2013 I was not eligible to claim Medicare benefits and have a Medicare levy exemption (MLE) certificate from Department of Human Services .

My Accountant ,ETax, asked for MLE certificate and private health insurance payment summary to claim the exemption.

However after reviewing the documents accountant said following: "After reviewing your private health cover statements your are not eligible for a government rebate amount under the visitor cover policies."

From July 01,2012 to April 21, 2013 it was not possible to use Medicare.
So why would ATO not refund the withheld Medicare Levy when Department of Health clearly states that I am eligible for MLE ?

Is the accountant right ?
I had IMAN top cover insurance and was on 457 visa.

I was in the same situation... got my MLE.. Submitted the letter with my tax return and got the money refunded......

Re-check with your accountant.. This doesn't look right

Absolutely correct. You are certainly eligible for getting the refund back. I would suggest you calling ATO directly, instead of going via the tax agent. they would be able to provide the best answer for your case.
