The applicant who likes to file his 189 eoi, has issues with his spouse and they are living seperate now. In this condition, He got to know that if a person married applies 189 visa, medical check for family is required even though they dont travel.

Though they are not legally seperated yet and nothing has been filed for it yet. In this situation, Can he apply the EOI as status seperated to avoid medical check of partner, as anyhow he is not taking his dependent to AU in future years. Could some one advise to get around this case.

In EOI, one can provide any information.

In mentioned case, if applicant writes separated, h/she have to provide a solid legal proof for that claim once invited and requested by CO such as either court order if its done or at least proof of divorce filing in court.

Besides, do check DIBP, whether medicals for non-migrating family members waived off recently or not
