I'm extending my spouse visa in roughly 5days time and last month my husband took out a loan to pay off a previous loan he had to pay off his credit card from late 2015 as we racked up a bit as things kept breaking i.e boiler,heating etc but this new loan was for the remainder of the last loans balance plus a bit extra to cover what we originally saved for my visa but was spent on bringing down the credit card debt.

Will this be a issue? Cuz I really don't want to have to move back to the USA with my 14 month old daughter who was born 14 weeks early and seeing specialist here in the UK.

Really stressing and can hardly sleep.

Can you fulfill the financial requirements i.e. your husband is earning enough to meet the 18,600 GBP per annum, plus of course the costs of the visa?

Having loans does not affect your application if you can meet the above.

My husband makes well over the threshold in fact he makes enough by their standard to cover me and 2-3 kids. Just was worried about the loan. Can they refuse my visa based off the loan? And what options are available to me if I'm resfused?

What legal recourse do I have if I am refused a extension of my spouse visa?
If, as you say, your husband earns about the minimum financial requirements, and you fulfill the other criteria there is no reason to suppose that your extension will fail.

It is does fail (usually because you have not fulfilled the requirements) you could appeal (if allowed), but if rightly refused then you won't win the appeal.

You could always obtain the services of an immigration lawyer to fight your case.

I'm asking cuz if does happen I know what I can do. Kinda like when I was refused a job here in the UK cuz I was American and I had no clue what I could do about it until months later.
