I am moving to France with my current company but i will be paid by the Paris office and will have a French contract.

There is a clause in the contract which states that if i leave to go and work for a competitor my company can basically stop me from doing this for two years and only have to pay me 30% of my salary.

This worries me, i have no intention of leaving but you never know what the future holds.

First question: is this standard procedure? if so is it generally enforced? presumably people do leave to go to competitors in France

Second question: if it is enforcible does anyone know if this is only enforcible in France or globally? It is highly unlikely i will work for a competitor in Paris, but what could be likely would be if I went to work for someone else and come back to London

Anyone any ideas?

This is the clause i am worried about:


En cas de rupture de votre contrat de travail et quelle qu’en soit la cause, pendant un délai maximum de deux ans suivant la fin de votre contrat de travail, vous vous obligez á ne pas travailler pour vous meme ou pour le compte de tout autre employeur sur des dossiers ou pour le compte a un client ou d’un client ou d’un prospect dont vous auriez eu á vous occupier dans notre Groupe depuis moins de deux ans, ni pour une entreprise concurrente á ceux-ci, sauf accord écrit et prélable de notre part. En contrepartie du respect de la clause de non-concurrence contenue dans le present paragraphe, vous percevrez unde indemnité brute dont le montant sera égal indemnité de conges payés comprise, á un total de 15% de votre dernier salaire annuel brut hors elements variables, si nous vous demandons de respecter cette clause pendant un délai de seulement un an, et de 30% de votre dernier salaire annuel brut hors elements vairables si nous vous demandons de respecter cette clause pendant la totalité du délai de deux ans.
Il est expressément entendu que, si nous vous libérons de cette clause de non-concurrence dans les trente jours suivant la date oú nous aurons connaissance de votre depart de la société aucune contrepartie financiére ne vous sera due.

Basically, the employer is permitted to include them, but if the restrictions are considered "abusive" they won't be enforced by the law.

So I would guess that there is very little could be done if it was a competitor in another country

The ban on "competition" is supposed to be limited to a reasonable period of time and to a limited geographical area. Certainly anything outside of France would be considered "unreasonable" in terms of scope.
