Hi am new to the forum and would appreciate your help .I am a non EU citizen with a EU spouse and a EU child .I have applied for EU permit in the UK but the application was refused based on the fact that my EU country does not recogniZe proxy marriages because we were married by proxy ,at the the time of application there was no child ,but after the application a child was born .we didn't qualify for cohabitation because we haven't lived together for the 2 years requirement and we only lived together for 7 months .

I want to know if anyone's been in this situation and what are the chances of winning an appeal based on family rights .Or would it be best to go back to home country and reapply ?But also I am an overstayer .Any help will be appreciated
