hi

I am family member of a person who is eea national from spain.
We got civil partner ship certificate for 3 years.
we live togheder in spain 18 month and we moved to uk 20 month ago
means 3 year and 2 month togheder.
i have a EEA family resident visa for 5 years. and is gone expire in 3 years .

but now she dont want to be here in uk, and she want to come back to spain

I have a few question:
I am non eea national. i run a company a few month ago, but i don't make a money yet. and i just start to run a new company.

If she go back to spain do i have right to stay in the UK?
If i have right to stay here. What documents i need to show?
if yes witch kind of visa they give me and how long is that visa?
they cancel my present visa and they give me another visa?


Please help me.

Are you in same-sex or opposite-sex relationship?
If you are in same-sex relationship with civil partnership or marriage, you may have a chance.
If you are in opposite-sex union without marriage (i.e. unmarried partnership), then it will be very difficult.

I've got civil partner ship certificate from Spain.
And when we move here to UK, the government give me 5 years EEA family resident visa .

Is not one option if I stay with my partner 3 years after that I have a right to stay here?

What do you mean by civil partnership certificate in Spain? Is it marriage or unmarried partnership? If you aren't married, even if you may have got your residence card, you aren't eligible for retained right of residence when your relationship breaks down as things stand at the moment. Some lawyers argue that unmarried partner of EEA citizen should be treated equally as married and those in same-sex civil partnership, but this hasn't been tested in court yet, so your chance is uncertain.
