In reading through the forum I saw some questions regarding child benefit and tax as it applies to my, hopeful, approved spouse visa. At this point in time my husband, UK, is receiving child benefit and tax credits, and hopefully soon child maintenance from his ex. When we went to complete the original application for tax credits, we informed the government that he was married and I was in the process of a spouse visa (which eventually was denied). They told him he couldn't apply as a joint account until I had a national insurance number.

My question is should my spouse visa be approved, will that entitle me to a national insurance number so we can apply properly? I don't want anything done incorrectly moving forward.

Yes and yes. The important thing is he declare on the first page of the form that you are subject to immigration control with no access to public funds (just a box to tick).
