can chinese citizen under J1 VISA get married with french in USA ?

hello everyone, so happy to find this forum !! here is my situation, kinda of complicated. but if i post this question at wrong forum, please accept my apologize and kindly let me know where should i go .

I was studying and working in france and came to USA one year ago under J1 VISA training program. my program ends in Dec 2012, but my J1 VISA expire on May 2012.( DS2019 form make me legal to work until Dec 2012 ) that means during May to Dec ,I can not make international travel otherwise i will not be able to reenter USA unless I renew my J1 visa in China.

My fiancé is french.

We wanna get married in July , our plan A was getting married in France, but if i apply shengen visa in USA and travel to france in July, i have to go back to china to renew my J1 USA visa after the marriage. besides i am not sure if i can apply shenggen short stay visa in USA if my j1 already expired. ---

Plan B--get married in China---but after review all the documents and procedure, this marriage and all the paper works will take up to 2 months. ----i don't have enough holidays in July.

Plan C-- get married in USA. But my question is, can i get married in USA with another foreigner even if i am chinese citizen and under j1 visa program ? since we both are foreigners, what documents are required ? after i get the livret de famille , will i be able to apply the spouse visa even if by then my j1 VISA will be expired already ? ( will need to apply visa in Dec , but pls notice that i have DS2019 form valid until Dec 2012)

Getting married in the US shouldn't be a problem. Check with your local city hall - some states have a residence requirement (e.g. you have to have lived in the state for a month or six months or so before you can get married there). Otherwise it should be pretty easy.

Your visa situation, however, is something you need to resolve. If your visa expires in May, you need to do something about extending it, regardless of the DS2019 form. Hopefully, someone here will have more information about that (because you need to be on a valid visa to use the French consulate in the US for filing the spouse visa application).

yea i actually thought about this question- need a valid visa to use the french consulate in the US, so ....maybe i should get married before May ? cuz i think the only choose for me to extend my visa is going back to china to renew the visa ...

Can regular chinese citizens travel abroad when they wish nowadays? Is there some kind of "limitation" (time or other). Is getting a passport "simple paperwork"?

LOL nice question jacques ! and yes we can travel around whenever we want as soon as you have enough money to cover the fees. " passport " is just like an ID, everyone CAN have one if u need it ! the point is visa but it is not a big deal neither nowadays . . i got my USA visa in ONE day .of course thanks to American's high efficiency lol but when i was applying french work permit in paris i waited around one month ..their administration procedures are freaking slow and complicated .:ranger:

of course everyone 's situation various .. but if u have a stable life in china, it is very easy to get a "tourism " visa .. however if u wanna immigrate abroad ,or work abroad, u need to have special skills . :juggle:

Hi, I am same as you. Have you married yet in May. If so, congratulations! Would like to share my case. I am Chinese and just have B1/B2 visa and my husband is French without visa (waiver program to USA). We got married in NY and got the license too. There is no restriction nor any document required when the time we married. But you must show your valid passport with valid visa, a little amount of registration fee. Then you need to go to the French Consul in NY to certify your marriage certificate/license if you get marry in NY state. If you will get marry in other state, check which FC office in USA would do the certify for you. Good Luck.
