Hello Everyone,

Hope everyone are safe and doing good in this pandemic situation.

I have query regarding Residence Calculator for applying Australia Citizenship.

As per the residence calculator tool, I am eligible to apply for citizenship as on 3rd Aug 2020. But when I phoned immi support, they are mentioning that I am not eligible until 11th Jan 2021. Key dates are as below -

Lawful Residence Date: 19th March 2015
Permanent Residence Date: 22nd Feb 2017

I have been in and out of country multiple times and have captured all those departure and arrival dates stamped in passport to calculate the eligibility date in residence calculator tool which says I am eligible as on 3rd Aug 2020.

Also, I meet ALL the general residence requirement -

1. living in Australia on a valid visa for the past 4 years
2. a permanent resident or eligible New Zealand citizen for the past 12 months
3. away from Australia for no more than 12 months in total in the past 4 years, including no more than 90 days in total in the past 12 months

Questions:

1. Which one to believe? Residence calculator date or date provided by immi phone support?
2. Why there is months difference with the dates derived by self vs date held by department?


Note: Currently I am unable to progress page 6 (residence requirement) page in application; but I know there should be a week buffer given from date shown in tool.

Give a week time buffer after you can move ahead of page 6 and you should be fine

Your dates are not very clear to provide an answer

In 2015, you entered Australia on which visa? When did you exit?
Provide your exit dates and re-entry dates after 2017
Did you stay out of country for more than a year in the last 4 years?
Did you stay out of country for more than 3 months in the last 12 months?

If the application is not allowing you to proceed, it means as of the date you tried, you dont meet the eligibility criteria
Residence calculator can be off at times, but application form gives a true picture

That’s correct
But most probably the system will not allow you to move ahead in the application till jan 2021

If you can , go ahead after a week

That’s correct

Why the date held by department is very different to the one that residence calculator shows? Got any idea on this?

Was the 485 visa valid for the period may 15 to jan 17 entire period ?

Sorry. It was 457 visa with which I first entered Australia on 19th Mar 2015. It was valid until 19th Dec 2015.

Later a new 457 visa was raised by my employer and the same was granted on 18th Oct 2016. It became void after I got my PR on 22nd Feb 2017.

I presume the dates that you have mentioned are when you were "Out of Australia". In that case, you will be eligible on or after 13 Jan 2021. That is because you have been out of Australia from 19 Dec 2015 to 14-Jan-2017, which is more than 12 months and your residence period for the last 4 years starts, which is 14 Jan 2017, and you will complete 4 years 4 years from thereon.

That is because you have been out of Australia from 19 Dec 2015 to 14-Jan-2017, which is more than 12 months and your residence period for the last 4 years starts, which is 14 Jan 2017, and you will complete 4 years 4 years from thereon.

I read that Lawful residence date is the date that you first arrived on any visa. In my case, it was 19th March 2015 with 457 visa.

Also based on current date, i.e. 4th Aug 2020; in the last 4 year duration (4th Aug 2016 to 4th Aug 2020) I wasn't away for more than 12 months based on the below out of Australia dates.

20-May-15 to 24-May-15
19-Dec-15 to 14-Jan-17
29-Apr-17 to 13-May-17
25-Aug-17 to 19-Jan-18
14-Jul-18 to 28-Jul-18
15-Dec-18 to 19-Dec-18
6-Mar-19 to 10-Mar-19
18-May-19 to 1-Jun-19
31-Oct-19 to 11-Nov-19

Kindly let me know if my understanding is incorrect.

I would take my above response back. Yes, you are right. Since I was without a valid visa from 19th Dec 2015, my lawful residence date got reset to 14th Jan 2017 from 19th Mar 2015.

Hence, the date held by department is true.

Yes, this can be confusing. The first rule is - "living in Australia on a valid visa for the past 4 years". If you look back 4 years, you weren't even here. Yes, you may have come before that, but that doesn't really count.

You were absent from 4th Aug 2016 to 14 Jan 2017. So technically, your 4 year period will be counted from this date. So, the helpdesk is correct in answering your query.

As you had no visa between dec 2015 and oct 2016, you cannot use the 2015 arrival for calculating residency
Your 4 years will start only in jan 2017 so earliest you can apply is oct 2020, if you came immediately after grant

He cannot apply in October because after his second 457 was granted in Oct 2016, he came into Australia on 14th Jan 2017. So it would allow him to apply only after 14th Jan 2021
