Hi, I am Australian who would like to return to the UK to be with my partner of 4.5 years, but have been held in Asutralia trying to sell my business. Due the the economy, my 7 week visit to Aus has turned into 19months - hence breaching my defacto visa conditions of living under the same roof as my partner for the duration on my visa.
A brief outline of us:
[*]Met May 2009
[*]I moved to UK May 2010 (holding Youth Mobility Visa for 2yrs)
[*]Applied/granted Unmarried Visa Jan 2012 - valid for 2yrs
[*] Feb 2012 Unplanned return to Aus due to business sale as we decided I permanently reside in UK
We had planned to marry a while ago but due to this distance, thought to wait.
My question: Are we better to apply for fiancé visa or get married? I am nervous of not being granted either due to our physical recent distance. Will this present a big problem when applying? I see double fee's being charged if we first go for fiancé then have to pay for married visa a few months later...? Thank you!:confused:

To add, we have had multiple trip between the UK and Australia during this recent 19 month separation.
