Hello

We were planning on moving to the uk thus week from Aus. Our child got sick and we had to cancel our flights on docs orders. Now my wife's eea family permit has expired. We were going to enter the uk one days before expiry.

Our children and I are eea nationals.

My question is can she enter the UK on her Aussie passport as a visitor which she doesn't need a visa for, with an expired eea family permit in the passport, and then apply for a residence card still even though her family permit is expired and she entered as an Aussie visitor?

Ukba were not very helpful in giving us a straight answer in this.

It's the question of whether she is allowed in on Code 1A stamp, given for those who are family members of an EEA national in the absence of EEA family permit. Expect some delay at the border, show marriage certificate, and hope for the best. Not ideal after a long flight with children, but you have no choice. Alternative would be to reapply for another permit, but with application going to Manila etc, it will take some time (a few weeks perhaps).
