My fiancé and I were married on 22 November his fiancé visa expires on 7 February 2014, what I would like to know is, is it ok to apply for the FLR now are do we have to wait nearer the time the visa expires (middle of January)? Having read some of the threads it seems like we do not have to wait but can apply as soon as we are married, is this correct?

I forgot to mention that my fiancé visa was refused initially because they doubted our relationship, we appeal and it was overturned, will this affect his application if he went for same day appointment?

Well, they do state that someone with a poor immigration history like a refused visa should not go for same-day premium service, but since your decision was overturned on appeal, I'd say you are eligible.
