Hi all,

The lawyer is telling my agent that our 457 has been lodged without payment apparently it's a trick they do so if your CO needs any further information it saves us 28 days. Will this still be lodged on the system or not can anyone advise me or is the lawyer just fobbing us off.

huh ? never heard of this. If you don't pay, your application isn't considered lodged at all. Definitely something wrong with your agent, you might wanna check if he's legit. DIAC doesn't take kindly to them tricks, they take their fees seriously!

I would agree with JBY. Like in any application you apply for that has fees, you will need to pay for the fees before they will even consider your application.

Did the lawyer lodge the visa online or on paper? If they did it online, that lawyer should have received a Transaction Reference Number (TRN). If you have this number then you can check online to check the progress of your application.

They are talking rubbish. DIAC is a business, they don't provide a service until it is paid for, they don't offer credit services! If they have tried to apply without payment it wouldn't be acknowledged, it would be an invalid application and the paperwork sent back to you/whoever applied.

Is this lawyer a registered migration agent? https://www.mara.gov.au/

Thanks guys, the lawyer refuses to give me the TRN number apparently he has had bad experiences in the past when given the number out. Will they even look at the application without payment cause he reckons they have come back with one question?

He's talking rubbish & probably not even a registered agent, I'd be getting rids of him & his services if it was me.

They won't look at it, it would be an invalid application and they wouldn't have paid it more than a passing glance as they posted it back to him.

He has no right to refuse to give you the TRN. It is meerly a reciept for lodging that allows you to track progress online. In my opinion he's not giving it to you because he doesn't have it because he hasn't lodged it!

The agent is supplied by the sponsor just Very frustrating the lawyer told the agent he lodged it on the 10th feb so we rang Australian house last week they said the sponsor has been approved a couple of weeks ago but nothing in system for our application so I got straight onto to the agent basically saying the lawyer is lying but the lawyer assures them ours is in the system probably not showing up because of non payment?????

If it hasn't been paid for its not been lodged. DIAC wouldn't even enter it in to the system as a case if its not been paid for, why would they do so and begin work on something they might never get the money for? Why has it not been paid for? Are you paying or your employer?

I would, just play coy how you're confused as to what's going on. They are after all paying this guy who may be taking them for a ride or dragging things out!

Managed to get a TRN number from agent checked with Australian house & they confirmed it was lodged on 23/2/12 happy days hopefully don't have to wait too long now.

Glad to hear it, hope it doesn't take too long.
You can use the TRN to log onto the system to see how they are progressing with it. Not always accurate as it's only as reliable as the humans updating it but it might give you some idea.

Thank you I tried that on Saturday when the agent gave it to me but it came back as nothing but like you said it's only as good as the imputer so I'll keep a eye on it. Once its granted does the confirmation get sent to the lawyer??

Yes, but it should also say on the website where you log in. So if you are obsessive checking it, many are lol, you might see it before he tells you.

an application is considered "loded" only after payment of fees..
if the CO needs further info then he will give more time..
