Hi All...i am seeking clarification to safeguard for future and be well prepared at the time for filing for PR.

At the time of my visa grant (subclass 489), my son (23 years old) was included as over 18 dependent. He lives with me in Adelaide and has started working. In the future when I meet the criteria for PR as the primary applicant, would he still be considered as dependent considering he continues to live with me and I evidence that I pay the rent for the house that we live in as his name is included in the lease? Does this in any way impact his pathway to PR as an over 18 dependent? If so, does he have to apply independently for PR and fulfil any additional criteria?

To include a child as migrating with you in your visa application, the child must:


over 18 years of age but not yet turned 23, and be dependent on you or your partner
or
over 23 years of age and be unable to earn a living to support themselves due to physical or cognitive limitations and be dependent on you or your partner (Note: The child will still need to meet Australia’s health requirement)
or

As he is over 23 years old and obviously he does not have any of the drawbacks mentioned in the 2nd part, he would have to apply independently for the PR

This is general condition and there may be a more specific route available for him, which I may not be aware of, so you may like to explore further
