We would like to remind you of the recent changes to 457 subclass visa announced on 1 July 2013. It has been confirmed that major changes will come into effect from November 2013.

The proposed changes coming up in November includes the following strict requirements as per the Amending Migration Act:

The sponsoring employer will need to provide substantial evidence of attempts to recruit qualified and experienced Australian citizens or permanent residents:

Evidence would need to include the following:
• attempts to recruit suitably qualified and experienced Australian citizens or Australian permanent residents;
• details of paid and unpaid advertising of the position;
• fees and expenses paid for that advertising;
• evidence of employer participating in relevant job and career expositions;
• payment towards any recruitment agencies and results from the recruitment attempts;
• copies or reference of any research released in the last 4 months relating to trends related to the nominated occupation;

If applicable the employer will also be required to provide information and supporting evidence in relation to any Australian citizens or Australian permanent residents who were made redundant or retrenched from positions in the nominated occupation in the last 4 months prior to the nomination being lodged;

The ONLY exemptions from the above requirement is if the occupation is highly skilled or if the employer can satisfy the Minister that a major disaster occurred in Australia and the exemption is necessary to assist in relief or recovery.

If you are looking to apply for 457 visa, you MUST start the process as soon as possible in order to lodge the application prior to November 2013
