Default Returning US Resident

Hi all,

I have received a job offer in the US as a university lecturer (I hold a PhD). I am a UK citizen with US spouse and chidlren, and we have been in the UK from 2013 to present. I have a 'green card' which expires at the end of this year, but probably isn't valid because I have not been resident in the US since 2013.

Should I reapply for a new green card, or a work visa? Not sure what the best route is as we want to re-settle in the US again. I have ruled out returning resident application as my absence in from the US has not beyond my control, but for going to university. We have maintained financial, tax, and family ties to the US however.

Your thoughts and advice would be helpful.

If you are interested in getting a work visa, you'll have to talk to your employer to see what sort of visa they are willing and/or able to get for you. Otherwise, I think you're probably going to have to start the greencard/spouse visa process all over again.

Having been out of the US for some 6 years, you have, technically, abandoned your green card, even if you never officially returned it.

As said if it's a work visa you want your new employer will have to apply for this for you - not you.

Otherwise try the spouse visa route
