Default Expat opening a company in the US

Hi

I was wondering if I opened a company in the USA, traded there (or from there) and paid all local taxes etc... am I allowed to live and work in the US ?

Do I need a Visa ?
What else do I need ?

It is just that the normal ways are to get married to a US citizen or to get Sponsorship both of which are difficult.

Any information appreciated

Aside from an approved visa - industry knowledge, being able to adjust to US way of doing business, funds to support yourself and your business until profits come in, pass regular audits and visa renewal applications, be ready to return to the UK if you do not stay within the perimeters of your visa.

Marriage for sake of immigration is considered fraud and brings legal ramnifications for all parties involved. Sponsorship depends on your professions and how good you are in it.

What is your nationality? There are visa options as a business owner. If your nationality qualifies you can apply for E-2 visa and start or buy an existing business. You must make a "substantial" investment in the venture. If you have a business back home with staff you can do the same thing and possibly apply for L-1 visa. The difference is E-2 limits by nationality and does not lead to a green card, it is classified as non-immigrant visa, L-1 can lead to green card eventually. Both will allow you to bring legal spouse and children under age 21. I am not an attorney but business broker specializing in immigration and just moved back to the US after two years abroad. Hope that helps.
