Question Once resident - how long back in UK?

Hi there,

Planning to move soon to Spain from the UK. Once officially resident in Spain, how long can we visit back in the UK? Months? Years? I believe the residency is valid for 5 years.

Why wait ? take the plunge and move ASAP - that way you get your UK driving license
exchanged for a Spanish one with no quibbles ( saving you 2 IDP permits
to drive through France and into Spain ) As the latest news is that DGT will allow
a grace period ( some say upto 9 months after final Brexit ) or face the Spanish
driving test to get one. After which you can be free from IDP's throughout
the EU, the UK and of course Ireland using your Spanish driving license.
Of course I'm talking about the ordinary driving license, not HGV licences, etc
where other considerations apply.

As for how long you would retain your Spanish residency after getting it and
then spending so many months or years ( a long sojourn in the UK ? )
Yes they say you can be away 5 years before it's curtains as far as your
rights to retain Spanish residency is concerned - back to the Spanish driving license.
DVLA say you can use it for upto 3 years upon your return to the UK
regardless of Brexit then it must be exchanged for a UK license.

Of course you will be UK tax resident a lot sooner than 3 or 5 years upon
your return to the UK.

I'm not sure how long you can be out of Spain once you have your temporary EU resident registration card.

I do know that once you are a permanent resident - after 5 years continuous registered residence in Spain, you lose that status if you leave for TWO years & have to start from scratch again.

What we don't know clearly yet, is what will happen to those Brits with temporary residence if/when Brexit happpens. If at that point they are treated the same as other third country nationals, then very little time can be spent outside Spain - just holidays - certainly not extended periods.
Then when it's time to renew, the absences are scrutinised & a renewal might be refused.

I would think it is he same as for those who have RESIDENCIA ( i.e. non EU nationals ). That is: up to one year unless there are medical reasons or family illness which may justify a longer period.

NB Once an EU national has had their EU Citizen Registration ( green paper ) for five years they automatically become permanent. There is no requirement to do anything after that. That the word ‘permanent’ does not appear on the green paper presents no problems as ones status is permanent

PS Further to my post.

I have just found another answer on the internet which says it is two years, for an EU national who has EU residence status an EU national.
