Smile applying for an unmarried partner visa from abroad

Hi all,

I've been trawling through all the posts on here and have already found out so much useful information, but I'm still stumped on a couple of things.

My partner (Australian) and I (British) are currently living in New Zealand, but are looking to return to the UK next year on an unmarried partner visa. I will be able to evidence that I have been earning over the financial requirement, but am struggling to figure out how I will be able to get a job offer in the UK with a start date within 3months of our return. I work in the hospitality industry and start dates for jobs are generally almost immediate and so I think I will struggle to secure a job whilst living abroad, especially as I won't even be able to tell potential employers my arrival date in the UK (until the visa has actually been approved). Has anyone been in a similar situation and can offer advice? Also, if I was able to secure a job for when we arrived back in the UK, would I have to stay at this job for a set amount of time to satisfy the visa?
Also, without knowing exactly where I will be based for work, I don't really want to have to sign a lease agreement on an apartment! Is it acceptable to book something like a short stay apartment for the first month of our arrival back in the UK?

Hello! I don't know the official rules for your exact situation. My gut tells me you may have to get set up in the uk before your wife can come with you. If the rules say you must have a job lined up, then you must. Same with accommodation. If the rules say you must have accommodation, then you must. Can it be temporary? That I'm not sure of. One of the mods can answer difinitively. I wish you the best of luck. I'm waiting for a visa so I can be with my British husband. It's been a lot of sacrifices, but worth it in the end. I hope you and your wife don't have to be apart.

In your situation, you probably have to get a job in UK, start, and after 6 months sponsor your partner for a visa. So you'll be separated by at least 6 months (plus visa processing and travel time). Or you take a holiday from your present job, return to UK on a job-hunting trip, and as soon as secure a job offer and accept it, explain to them you need a couple of weeks in order to return to Australia, submit your partner's visa application, give notice to quit and fly back to start your new job. This assumes you are applying under Cat A, which requires you to be still in job in New Zealand when your partner applies for visa. If you can apply under Cat B, you can quit your job before returning to UK to job-hunt, then return home while your partner applies, and then you can either travel to UK ahead of your partner to start your job or wait until the visa is issued and travel together. What is very important is that you do NOT start your UK job before your partner applies online for visa. If that happens, you are forced to wait 6 months as in the first scenario.
