Hello,

I've spent the last several days reading the forums and have found them incredibly helpful. I have a maybe unique situation that worries me and I haven't been able to find it in the threads.

My spouse and I currently live in the US. I have dual citizenship, US and UK. My sister, who lives in the UK, has offered me a job in a company she is a director in. And, seeing as how it would be fairly difficult to find a place to rent before moving, she has also offered to let us live with her and her family until we get our own place. It's like a dream come true!

Since I'm a UK citizen, I'd be able to use this job offer to bring my spouse with me on a spouse visa. My concern is that this job offer, especially coupled with us temporarily moving in with the same family member who is offering me a position, would seem suspect.

The job offer meets the financial requirements of Appendix FM, 4. The guide to supporting documentation recommends we provide any relevant information but I'm not sure if this particular situation would be considered "relevant". I think it's quite common for a family members to work at the same company and since the offer is legitimate and I can legally work in the UK, I'm not sure how much of a difference it makes. But of course, I don't want to appear as if we are not being forthcoming.

This brings me to my dilemma, is it better to point out the a family member has offered me a job and that it's the same family member we'll be staying with in the first few months or should we simply provide the contract documentation for the job and the accommodation documentation without pointing out the connection? Would they have a way of seeing that my sister is a director in the company? And, if we do point out the family member connection, is there anything extra we can provide to proof the legitimacy of the job offer?

I may be overthinking this and making it more complicated than it needs to be but I don't want to jeopardize our chances of getting the spouse visa approved.

If anyone has had a similar experience and/or has any recommendations, I would greatly appreciate it!

I wouldn't complicate things. I would do it in two separate entities. The company of which she is a director has offered you a job. Send contract or job offer on a letterhead stating start date, annual salary and position. Accommodation I would say my sister has offered us to live with her until we find our own place, I showed a letter of invite, proof there was room and a copy of my mothers passport and step dad. I'm sure if they had any suspicions they would do checks on the company. It would be illegal and punishable act for any company to offer false employment to assist anyone with gaining entry into the UK.

I should have added that you would also have to prove that your current job in the US meets the financial requirements. If you are applying for a spouse visa on the job offer here.

Thank you so much for the quick reply! I feel more at ease hearing that I can keep the two entities separate.

I do meet the financial requirements with my current position as well, so that shouldn't be a problem.
