Default Higher English Language Requirement from October 2013

If someone is on spouse visa (post July rule change) will they be required to meet the B1 English level and have passed the Life in the UK test in order to apply for the visa extension after 2.5 years? Or will this only be required at the 5 year point in order to apply for ILR?
