Default EU Settlement Scheme & Absent .

Hi All

Hope everyone are safe and well during this CoronaVirus period.

Please i have 2 questions for anyone who can help.

1, EU National and his family living in the UK who has right to reside, The non eu has lost her passport and what can be idea stuff to proof the non eu has resided in the UK for 5 years is the non eu lost her passport but has the UK resident card.

2) same to the EU when applying for Settlement Status how can HOME OFFICE know the EU National has resided in the UK without staying outside of the UK for more then the normal absent period days.

1. The passport alone doesn't prove continuous residence, although she will need a new passport issued if she applies for something else in the future.

2. Home Office use automated checks to see when you were in the country - paying tax, claiming benefits, working etc. If there are gaps in residence then the burden of proof is on the applicant. This is how they know when you were absent.

Thanks for your Assistance,

Please i want to ask one question,

The EU national is the main source for Home Office to grant the Non EU Family status right because the NON EU is partner to the EU National or Dependent to the EU National?
