Hi!

My non-EU wife and I arrived in the UK by coach 3 months ago.

The border control did not put any stamps on my wife's passport.

We have been married 9 years.

One month ago we were blessed to give birth to our first child, in the UK.

Prior to coming to the UK we lived in an EU state for 3 years where my wife acquired her residence card for a family member of an EU citizen.

We have family and relatives here in the UK whereas in the other EU state we had none.

I work full time and have paid 6 months rent in advance on our house, 3 months ago.

My wife has her NHS number and bank account. We are applying for her National Insurance number.

Before living in the other EU state for 3 years with my wife, I moved to another UK territory in the EU where I applied once for my wife to join me and was refused since immigration assumed we were just trying to get into the UK. I was there six months in total.

Before that, for five years, my wife was living in her non-EU country of origin and I in the UK where I was undergoing chemotherapy hence why I could not work nor travel... and why we're extremely grateful to finally have our child, naturally.

We applied then twice for a spouse visa but were rejected on both financial grounds and also compassionate considerations.

But now we're here with our family and good health care, we are looking at applying for the UK residence card for my wife to extend her stay.

Of course, we want to settle indefinitely as a family where we have family. But for now, with no stamp in my wife's passport, can my wife apply for the UK residence card after 3 months has passed or does it have to be within 3 months after arrival?

And does this 3 month deadline apply if we go the Surrinder Sing route?
