Default Will it be ok I apply for my residency card 5 days before expiry of my family permit?

I am Chinese, married with spanish. my husband works and lives UK. I arrived in UK on Sept and my family permit visa is valid until 6th Jan 2012.
As i have to show my marriage certificate in original to the police while i enter Spain on this Dec for Christmas, i would like to submit my application for residence card under EEA2 on 2nd Jan when i am back from Spain.

Will it be ok if i apply for the residence card just 5 days before my family permit expires on 6th Jan? will it be too late?

Thanks a lot for your advice, which will be very helpful.

That's fine, and even if you 'overstay' your EEA permit, you can still apply, as both EEA permit and residence card aren't 'legally' required (but strongly advised to have them).
