Unhappy denied a special catagory visa

hi all

i live in australia with DH and kids and i am trying find out some information for a friend who is a new zealand citizen trying to make the move to australia to live and work. they filled out the consent to disclosure form and sent it to the australian consulate general in auckland new zealand and received a reply saying that based on their findings they find them not of good character to be granted a SCV but allowed entry only on a tourist visa. the criminal convictions are 12 months sentence but served only 3 for good behaviour for drinking and driving 8 years ago and then 4 years ago was charged for assault. so my question is if they have been denied once they cant get it ever again? or is their a way to contest? or get some other visa i have gone through so many web pages and come up with nothing PLEASE HELP.... thanks

Hi there,

Welcome to the forum.

If anyone has had a custodial sentence then there's practically no chance of them getting any visa whatsoever I'm afraid.

Have you thought of running this by a migration agent, they may know some way around it?

you were sentanced for 12 months and that's the key. Doesn't matter hwo much you served the sentancing amount is the key.
