Default 189 and Military Service

Hi All

I'm originally from Iran and military service back there is compulsory as soon as you turn 18.

I came to Australia when i was 17 and am planning to permanently stay. I'm in the process of getting my assessment and am confident i will get an invite in the next 6-7 months, fingers crossed.

Question is, is the fact that i haven't completed the compulsory service gonna cause me any issues when i lodge my visa?

As long as you can get a PCC from your home country, you should be safe

While not directly pertinent to your question....

It is worth noting that it may be an issue if you ever want to return to Iran... even if just to visit. You may not be planning to do so now, but it is difficult to predict the future.

You may want to look at what options are available to formally request a deferral of your service requirements until you "age out" of the program.

This is a common approach for nationals of countries that have mandatory service or draft registration requirements.

Unfortunately, i haven't been able to find such option and don't think I can use the "age out" method as i'm only 24.

Do you know what would be the solution for my case if the CO comes back and requests military record or something similar? How can I can assure the CO it wont be a problem?

Honestly, I don't have an answer to your question, however some points to note,

CO normally asks for a discharge certificate if anyone had to do military service in their country.

In your case, you were not eligible when you left Iran, so never enrolled in Military. I'm not sure what the law states in Iran, if an Iranian happens to be outside Iran when he turned 18. You can still apply for your visa and then chose an option to confirm you have not served in the military.

See what document list does it prop up based on your nationality and your answer on military service

As you are in Australia, you could always try contacting the Iranian Embassy in Canberra.

Why would the CO request for military records if you have never served in the military and not even eligible as per age ?

My bad if i didn't make it clear. I have not served in the military BUT I am eligible now since im above 18. So basically if I ever go back, i can't exit the country until i finish service.

Like I said, Answer "No" to the question about military in your application and see what document list does it prop up based on your nationality and your answer on military service. CO will not ask for something that you have not done or doesn't exist.

In the meantime, do look around Iranian rules around compulsory military service for it's citizens residing outside Iran. If it only says, that you need to start the server, as and when you return, then you are not breaking any law.
