Default Include de facto after 190 lodgement

Hi guys,

I recently applied for 190 and is now waiting for result. The thing is I want to amend my application to include my de facto partner before the decision is made on my 190. However, I have a few concerns:
1. We have been living together in Australia for 8 months (total time), however, it was 5 months same address, then about 4 months apart because she moved to different state for job, then finally came back to me and it has been 3 months since then. Therefore, can I include her as my de facto?
2. We have been dating as gf/bg back home since 2016, which is nearly 4 years by now (but only moved in together for a total of 8 months as mentioned above). We got emails, conversations, photos etc...as proof. Is this strong enough to prove our de facto relationship even though we have not been together for at least 12 months?
3. Is there any chance they reject my partner's application? And whether this will affect my 190 application result? (meaning they reject both of us under 190 application?)

Hi mate,

Yes I did. But my total point was 80, far above the min. of 65 points. And I am living in Northern Territory which only requires 65.

Also, NT does not have an office to register de facto relationship, which is quite troublesome...

Itís immaterial whether you need the points or not
Once you have claimed the points, you have to prove them
So you cannot add your de facto to the application
Only after the grant you can apply for her separately

Thanks mate! I did some research and I thought we could fill form 1436 to add your partner as long as a decision has not been made on your 190 visa

Hmm very tricky that is...Who could have thought that we should not claim point for being single just in case you need to add a partner later on!
