Default Backdated reference letter for current employment - ACS Skill Validation

Hi Experts

Kindly help me, as I am worried if my ACS skill validation will get rejected.

I have been working for the same IT company since passing out of college. My employer doesn't give Employer Reference letter in the format ACS expects. My only way forward is to ask an ex-colleague of mine to provide Employer reference as a STATUTORY DECLARATION.

The ex-colleague was my supervisor throughout my employment, till he was part of my company and moved away only 6 months ago. I want to claim my skill assessment only till that time as I have already completed the 7 year buffer. Also, I do not want him to declare till current date, as I don't want him to lie. There is no other colleague or supervisor currently who can testify what I did for last 8 years.

As the ex-colleague moved away 6 months ago, can I keep the Reference Letter Date as end of December 2018? I want ACS validation only till that date, even though the employment is CURRENT.

The declaration will look like:

STATUTORY DECLARATION

Date reference letter 31/12/2018

I, Mr. XYZ declares as follows:

Mr ABC has been working for EMPLOYER1 as a full time permanent employee from 6th June 2011 to date.

..........Actual Details........
.....................................

Sworn at: PLACE

Date: 10/06/2019

Signature: SIGNATURE

-----------------------------------------------------------------------------------------

Would this be ok?
ACS suggests: If your employment is “Current”, the employer reference should state the term “To Date” and MUST include the date the reference was written.

If I were to do it, this is how I would word it


STATUTORY DECLARATION


I, Mr. XYZ declares as follows:
XYZ present designation, company name, official contact email , mobile number

Mr ABC has been working for EMPLOYER1 as a full time permanent employee from 6th June 2011 to date.

I supervised him on day to day basis and was aware of his RnR from 6th June 2011 to 6th December 2018

..........Actual Details........
.....................................

Sworn at: PLACE

Date: 10/06/2019

Signature: SIGNATURE
