Default Australian PR 189 and 482 simultaneously in queue

Hi all,

I have submitted EOI for visa type 189 in the month of April 2019 with 75 points from India. However, my employer is raising TSS Visa 482 immediately for me, my spouse and child. I have few doubts regarding my situation:

1. Can I apply for both the visas in parallel? If yes, what if I process 189 and 482 simultaneously?

2. What will happen if I receive 482 before 189? In case if I receive 482, then will I be allowed to continue with the processing of my 189 after invite? Will I be allowed to pay visa fees and upload documents for PR? Do I need to withdraw 482 visa. What is the process to withdraw 482 visa? Do I have to resign current employer or is there any other way to switch to 189 without discounting current employer.

3. What will happen if I complete all the visa processing and receive 189 before 482? And then if 482 visa is issued from employer, then will it override my 189?

1. YES

2. If you get the 482, nothing changes for the 189 application
It will continue to be processed as earlier
You just have to intimate the co that you have been issued a 482 and you are relocating to Australia

3. If the 189 is issued, you should immediately apply to withdraw the 482 application
If the 482 is issued, then the 189 will stand cancelled

Thanks for the quick response.

Regarding 3rd point, as company would be filing for 482, then is that the case, that only company can withdraw the application? Or can I withdraw it independently? Also, if you know the process of withdrawal, can you guide me? It would be really helpful.

If the company has filed it, only they can withdraw

Have a discussion with the agent who has filed the application for the company
Request him to keep the papers ready for withdrawal the moment the 189 is issued

You cannot do anything independently, so keep the agent in good humour
