Default Need Help with Employment Evidence for ACS/Visa

Hi Team,

I need help with ACS assessment for the company which got closed few months back.

I worked in USA for this company for 1 Year and 6 months and I have the following documents

1. Reference letter which I took in mid of my term saying ( I'm working as xxxx with salary xxx since <date>) on their letter head.

2. Payslips (70 % of payslips available)

3. Tax documents

4. I have Visa printed on my passport with this company name which has start and end date of 3 years. However, I worked them for 1 year and 6 months as mentioned above.

Now I'm planning to take notary (SD) from an ex-colleague who worked there for ACS assessment.


What documents do I need for ACS along with SD?
Will ACS or Visa officer after invite ask me some more docs?

It would cost me 5 points if I do not include this experience and my points would be back to 70 (261313) for 189.

Note : I do not have any relieving letter or offer letter for the same.

Any help will be appreciated.

It would be extremely risky to claim this experience
Do you have the bank statement in which the salary was credited?
Any particular reason why you donít have an offer letter and relieving letter ?

Thanks NB for the response.
Terms were not good between us and had to leave him.
I do have bank statements saying cheque deposited, but the amount is different in bank statement when compared to the payslip.

Payslip says 3200 $ and I was paid 3500$

This is because I used to work overtime and was paid by the hour by client and employer generated standard payslips every time having the same amount.

Point 3&4 are third party evidences and they strong ones.

It will be perfect If you have bank statement where your transaction could show the salary payments.

Terms were not good between us and had to leave him.
I do have bank statements saying cheque deposited with reference number, but the amount is different in bank statement when compared to the payslip.

Payslip says 3200 $ and I was paid 3500$

This is because I used to work overtime and was paid by the hour by client and employer generated standard payslips every time having the same amount.

Will this cause an issue?

It raises concerns, but how the CO will see it no-one can say. If the bank statement gives details of depositing company I guess that would help. Is there any public record of the company winding up?

Extremely risky to claim points

You may have to fight out the department in case of a NJL

Yeah I came to know until last week. When their emails started getting bouncing back and there is no evidence of their portal existing now and I looked online and has no source of when it got winded up.

Thanks for the response NB.
Yeah you are right, it's the matter of PR and not like a simple Visa.
I might give up on this 5 points experience and hoping my profile will get atleast state nomination (70+5) with actual 6 years of experience in a year time.

So now,
If I do not consider this experience and get successful as for the rest of the experience.
What shall I expect from Visa officer for the above not counted experience when my visa gets lodged.

The documents which I have mentioned above are sufficient enough to prove the gap and do Visa officer expects justification from my side for the employement?
