190 Residency Obligations and Citizenship

Hi,

I got a 190 Visa (PR state sponsored NSW) in August 2015. I had to make my initial entry by 10 July 2016 and i did visit Sydney in March 2016 stayed for like 3 days and returned to my home country. I did not apply for medicare or any other benefit.

Since then i have been in my home country and my visa states i must not arrive to Aus after 03 August 2020.

What i want to know is whether i need meet any residency obligation by Aug 2020 or am i good to move there even a day before the expiry date. ( 3 Aug 2020 )

If i do move by June 2020, to move out of Australia what should i obtain and how difficult is it ?

I'm married now and wasn't married when i applied for the PR. can i apply for spouse visa/PR from my home country and after she gets that move to Australia together with her ?

your advice is much appreciated.

Yes, you can enter the country a day before expiry.

In order to be eligible for a resident return visa, you will need to have lived in Australia for at least 2 years. So if you enter Australia 2 Aug 2020, your PR remains valid, but if you leave before 2 Aug 2022, you will likely not be able to get your PR back unless you are able to provide compelling reasons as to why you have not fulfilled your residency requirements.

You can apply for your spouse visa offshore but it will come with the same residency obligations. You can move to Australia with your spouse and apply for a spouse visa while you're there, which will allow your spouse to remain in the country while the visa is processing, you don't have to wait offshore.

Do note partner visa may have a requirement that the PR/citizen sponsor is "usually resident" in Australia.

Like the genuine temporary entrant criteria for visitor visas, this can vary depending on each case.
