Default UK girlfriend moving to france

I cant find clear answers on google and i have contacted the relevant administrations and i am waiting for their reply but in the meantime i thought id ask here...

my brit girlfriend (currently in UK) and I (i am french, residing in france) are thinking of getting into a PACS and moving in together... however i have a few uncertainties:
  • as far as i understand she just need to declare herself as permanent resident at the Mairie upon arrival, is that correct?
  • i am currently unemployed and i get RMI, how would the PACS affect the RMI?
  • she'd be leaving her job to move to france; can she register for ANPE/Assedic?
  • nowing that her french is not very good is this likely going to affect her eventual ANPE/Assedic registration and would they provide french lessons?
  • i know she can get a Carte Vitale following the PACS; but what is the timeframe to ask for one after the PACS?

and also what do you think the timeline for it all should be?

Hi and welcome to the forum.

Well, as a UK citizen, your girlfriend has every right to come live and work in France, so that's the easy part. AFAIK, there is no need to declare herself resident at the mairie. For the PACS, you will have to declare where you both are resident together, so that should be adequate - but I believe that is part of the PACS paperwork and not something she needs to do on her own.

I suspect she can still register with La Pole d'emploi (which is what ANPE/Assedic is calling themselves these days), but whether she is entitled to any benefits is doubtful if she is voluntarily leaving her job in the UK. I don't think La Pole d'emploi will give her French lessons, but they may know some of the providers of language training in the area. Her chances of finding work are fairly slim until she can speak French at some basic level.

For the carte vitale, she needs to have a form from the UK showing that she has paid into the UK system for some period of time. (Independent of the PACS.) Once you are PACS'd, you can see about putting her on your carte vitale (as a dependent). I would check with the mairie where you are doing the PACS.
Cheers,
Bev

well the reason i was wondering if it would be possible is that under french law, "dependents" (pacs or married) who left their job for the sole purpose of relocating with their partner are entitled to job seeker benefits BUT i dont know if that applies only to french nationals.

The way I understand it is that for her coming from the UK, she would normally be entitled to receive her unemployment based on her UK contributions for some period of time in France. But it depends on how the UK treats leaving a job to join a partner. (And I suspect that even in France, you need to be already married or PACS'd at the time that she leaves her job.)

She should check with the unemployment people in the UK. At the least, she'll need some form or certificate from them that she is eligible for UK benefits. If she has that, I think she can get her UK benefits from France.
Cheers,
Bev
