I agree its down to the poster to find legal issues out and being honest if the poster doesnt want peoples views and input , then you should advise the Poster in Bold letters " Seek a Lawyer - Solicitor do not post asking for views "

Had i posted the same question i would love to read what the genuine feeling is and then way up from there ..

My input is from experience and stands ! But the poster obviously knows that its his ultimate decision surely ?

Maybe the OP will let me know his views was i useful or not ?

Hi!

On the base of the new building regulations per 1.10.2007:


1. Window remplacement : no déclaration de travaux. If you have it done by a firm, and if they are double windows according certain norms ( as the firm), you can get an income tax réduction on the value of the material ( not the work ), if it is you main residence. Form 2042/page4/boxWG - send copy of the invoice.

2. Loft:

You have this:

Inside conversion-Aménagements intérieurs -

-No authorization if the work does not modify the exterior aspect, and is no change of the purpose, and does not add extra levels.

-Aménagements intérieurs-DP (Déclaration préalable) < 20 sqm SHOB (Surface hors-oeuvre brute)

-Aménagements intérieurs-PC > 20sqm SHOB (Surface hors-oeuvre brute)

and/or this:

Change of object for a building - Changement de destination d’un bâtiment - DP even if no construction work is involved (Art. R421-17 du code de l’urbanisme


-PC if changes are made in the carrying structure or if the front ( means the outside of building ) is modified (Art. R421-14 du code de l’urbanisme)

If the OP gives me £ 600 which i estimate would be the cost to get his plans done and put in etc , then YES ..

I would take the gamble that if he got caught i would pay the fine as i doubt it would be no more than £ 500

As long as there is no exterior changes made i doubt anyone cares a eyeoter so would happily act as his insurance policy ..

Default planning permission in france

We recenty posted a question about obtaining planning permission in France. We seemed to get back a lots of opinions but very little advice. As far as I am concerned you have to get permission to carry out any renovations otherwise you fall foul of of the terrifying French beurocracy and become entangled in their oblique procedures for everymore. Anyway, we finally found a nice young French couple who speak impeccable english and are able to do what they say they are going to do ie if they say they will do something by a certain date they do it, they run a property management service in Normandy and if anone needs any help I would recommend them. They have obtained the correct form from the planning office (DDE) and have filled it in and filed it for us. We are now hoping that our modest request to upgrade our property is granted before too long. Have a good Christmas everybody.

According to the new regulations you have:

Attic-Combles- With NO changes in the outside aspect:No authorisation for less than 10 sqm SHOB ( Surface hors-oeuvre brute) transformed in SHON (Surface hors-oeuvre nette)

-DP (Déclaration préalable) if more than 10 sqm SHOB (Surface hors-oeuvre brute) transformed in SHON (Surface hors-oeuvre nette) (Art. R421-17 du code de l’urbanisme)

Windows:

New openings incl. modifications -Création d’ouverture /aussi modifications -

DP (Déclaration préalable) (Art. R 421-17 du code de l’urbanisme)

Since any declaration means that you living quarters are being improved, and imply an increase of the Taxe d'habitation, not doing it is a Tax avoidance.

If for some reason other other it comes out later, they will correct with fine.
