Flat Let Landlord Not Paid Maintenance Fees

Hoping for some advice a friend has rented a flat via a registered agent (paid in one cheque from her employer 1 month ago) and when she tried to enter the underground car park today she was blocked by the building operators as her landlord has not paid maintenance fees for some period.

She has also been denied access to the pool and gym area.

She has contacted the agent to resolve this and legally she is obviously in the right however this being Dubai what is the best way for a quick resolution if the agent does not solve quickly? Does the agent not have an obligation to check such maters?:confused2:

This is becoming more and more common as the first year warranties expire on privately owned premises and landlords cannot afford maintenance fees. My friend lives in JLT and they are doing it in her block. Unfortunately, most agents here are not renowned for their integrity. Unless the agent is managing the property for the owner, the relationship now lies between the tenant (your friend or is the lease in the company's name) and the landlord. Does your friend have the landlord's number or email address (she would need this for termination or renewal purposes) - it may be on the lease document. If not, she should ask the agent or the building management office for it. After contacting the landlord, if she has no success, the next step has to be to go to RERA to find out where she stands legally. When I arrange leases for staff in my company's name, one of the first discussions I have with the agent is about maintenance, how it is handled, what is covered, to what extent and the contact details. We would then ensure this information is captured in the tenancy agreement. It's a shame your friend's company did not offer her more advice/assistance particularly as it's their money that's been put up front to pay for this.
