Marrying a Peruvian - specific questions

Morning All

We are trying to sort through all the movements required in order to get married here in the UK. I am a UK citizen and my fiancé is Peruvian.

So far, I know this much:

1. He needs to get a COA so we can marry here
2. Once he has that, he has to be here for 7 calendar nights before we can give notice to marry, which has to be "up on the board in public" (I love this place) for 15 full days
3. Hey presto, we're married
4. He can then apply

to change his visitor's visa to a spousal visa

However, can anyone help with these specific questions:

• Will they keep both our original passports for (up to the full) 3 months while granting the COA? We both travel for business....
• If he comes back to the UK in August so we can get married, and is still on a tourist visa, can he apply for a Settlement Visa whilst already in the UK? Or does he have to leave on the tourist visa and come back in a my husband?

All help gratefully received. The UKBA website is pretty good but it's missed both of these points out...
