Default Income Threshold Question

My spouse and I both reside in the UK. She is a UK citizen, I am a US citizen on a student visa. We are planning to apply for a spouse visa next May.

My spouse is starting a new job in September that will pay her £16,750 per year and she has also been offered translation work through her father's small business on a open-ended contractual basis. Assuming that she is provided with all of the relevant paperwork through her father's accountant (contract, letter, payslips, evidence of deposits and P60), could this supplemental income be counted towards the £18,600 threshold?

According to visa rules, she needs to have earned £18,600 in the six months leading up to the date of application by working for the same employer. In case of more than one employer, she needs to have earned the minimum amount in the preceding 12 months. As she is only starting her new job in September, this is out. If you have enough savings - kept untouched for 6 month - i.e. 2.5 x (18600 - 16750) + 16000 = £20,625, you can plug the gap. Or if you earn any money working under Tiere 4, that can go towards it as well. Other things that can be counted include investment income and rental income.

Thank you for the clarification. Here is an alternative scenario...If I were to take on contractual work for her father's business, i.e. market research, proof reading...Would this be counted towards the income threshold for the 6month calculation period?

ie, this would be income earned under my Tier 4 visa.

Possibly. You must stick to the limit imposed by your visa on how much you can work - typically 20 hours/week in term time and full-time at weekends and in vacations. In case of working for a family member, there is a suspicion of fraud so make sure everythinbg is above board and you are being paid properly for the work you perform, under contract etc, which should be enclosed.

Thanks again, really helpful information. (Hopefully) final question...If I were to apply from within the UK (necessary for including my income towards the £18600), is it necessary for me to have at least 6 months remaining on my student visa from the date of my application?

No. Apply before it expires.
