Is FLR next or Spouse Visa?

Default Is FLR next or Spouse Visa?

Hi All,

My fiance is here in the UK on a fiance visa which expires in August 2012.

We married on the 14th April and are now looking at the next stages.

Do we now have to apply for FLR or for a spouse visa? I've checked the UKBA website, it says we can transfer from fiance to spouse visa but I've been reading on this forum that we might not have to do that and we can go straight to FLR? Can we apply straight away or do we have to wait 28 days before the expiry date in August?

Would he also have to have his biometrics taken again? He had them done when he applied for the fiance visa from Australia.

You apply for FLR and you can do it anytime after the wedding provided you have the marriage certificate.

They are in effect the same thing - called FLR as spouse of a British citizen if you are applying in UK (as you are) and spouse visa or settlement visa if you apply outside (which you don't have to).

You are eligible to apply now for FLR. I suggest you pay more for same-day premium service. New biometrics will be needed, done during your premium service appointment.

Thank you Joppa.

Is there anything specific we need to include with this visa application? (Apart from the marriage certificate).

Is it just a case of updating all the paperwork we obtained for the fiance visa ie. sending more recent bank statements etc? We went quite in depth with evidence of how we met but would we need to do that for the spouse visa?

Yes, but since you are married, you don't need extensive evidence of how you've kept in touch.

Hi ,
It's just hassle to find what u want from the home office, I
On spouse visa at the moment , I have to do my indefinite leave to remain after 10 month , I do t k ow if I have to do the biometric information thing, or the 2 years spouse visa start from the date of issue or the date of the arrival into the uk, they just don't answer the phone, and I can't find more information on there website!

It's all there if you know where to look!
To answer your questions:
Yes, biometrics are required, and instead of a sticker in your passport, you get a biometric residence permit (BRP), which will be the only proof that you have ILR, so you mustn't travel without it.
2 year probationary period starts from the date of entry into UK. You can apply from 28 days short of full two years.

No form to complete but how you do biometrics depends on how you apply. If you go for same-day premium service (highly recommended), it will all be done during the appointment so nothing further for you to do. If you apply by post, they normally write to you after they receive your application inviting you to make a biometric appointment, which can now be done at some post offices for a price.

Aahhhh , I c, I most do it then, I thought I need to download a form from ukba first, I have 1 more question my spouse visa issued 24 .01.11 and expired on the 24.04.13 witch is 27 months I landed in the uk on the 3.03.11 witch is 1 month after the dye of issue , I still ok to to ILR? I di t have to do FLR ? Am I right? Thx again juppa
