I got my Permanent Residency back in 2009. After getting my PR I visited Australia twice, once in 2009 and again in 2010.

Based on my circumstances I don’t think I will be able to migrate to Australia before 3 year expiration period, which is mid of 2012. However, I am quite confident that I will be able to migrate in 2013.

I want to understand the rules. Do I need to live in Australia for 2 years in first 5 years as per dates on visa? If yes, how can I extend my PR so that I can migrate in 2013?

Any feedback/suggestion is highly appreciated.

Hi there,

Once your PR visa expires you will have to apply for a RRV (Resident Return Visa) Five Year Resident Return Visa (Subclass 155) but this is only if you wish to travel overseas. Otherwise you can stay for as long as you like. The main requirement for the RRV is that you have been physically present in Australia for 2 out of the preceding 5 years.

Just to note, your PR visa remains valid indefinitely.

Hi:

Please note there is a 3 month RRV for cases such as yours. It would be a bit pricey but renewing for 3 months at a time until you can move over would keep you legal and avoid the need to apply for a brand new PR after 2012.

Please contact DIAC and discuss your situation so you can apply for a 3 month RRV before your first RRV (the one granted simultaneously with your PR) expires.

Hi amaslam,

I appreciate your response and providing me with the information on 3 months RRV. In fact the visa sticker on my passport is stamped for 5 years and is good until 2014. My 3 years period expires in 2012 (this is not marked anywhere on my passport just my interpretation of 3 year rule).

Based on reading the links provided by Dolly, it seems that I should be ok migrating in 2013 with the caveat that my options to travel outside the Australia will be somewhat restricted for the first two years since that is a requirement to renew 5 year RRV. Are you of the same opinion?

I will be in touch with DIAC soon for the confirmation. Somehow I am not able to get through DIAC numbers from here but will try more before giving up.
