Default Planning to renew your Australia permanent residency visa?

HOW TO RENEW YOUR AUSTRALIA PERMANENT RESIDENCY VISA?

1) Physical residence in Australia.

Being resident in Australia for at least two years in the period of five years (only permanent residence may be counted) immediately before renewing your visa application will greatly enhance your eligibility for the visa subclass 155 Resident Return visa (RRV).

2) If you are not able to meet the above residence requirement, you may still be eligible for the RRV if you can evidence substantial ties such as business, cultural, employment or personal ties with Australia.

Business Ties
Examples of business ties:
a) Being involve with an Australian business or an overseas branch of an international business with business ties to Australia.
b) Being involved in an ongoing business activity which generates revenue for Australia.
c) Being involved in a business activity which transfers technology to or from Australia.

Cultural Ties
a) Cultural pursuits conducted at a professional level (with a degree of public recognition) which enrich life in Australia, raise profile of Australian achievements overseas or increase international goodwill or respect for Australia.

Employment Ties
Examples of employment ties:
a) Employed in Australia by an Australian company.
b) Acceptance of a formal offer of employment in Australia.
c) Employed outside Australia by Australian organisations.
d) Employed by an organisation whose activities are beneficial to Australia.

Personal Ties
Examples of personal ties:
a) Long term residence in Australia before the five years prior to the application.
b) Ownership of a home or other major personal assets in Australia.
c) Close family members who are Australian citizens or permanent residents living in Australia.

* Evidence to demonstrate ties with Australia is assessed on a case by case basis.

Hi Nancy,

When you say renew your PR are you talking about applying for RRV or something else?

BTW once you've made 5 good posts you'll be able to put links in your posts but please read the forums terms and conditions since unsolicited links will be deleted. All business information should be in your signature - until you've made 5 posts you won't have access to the private messaging system either otherwise I would have sent you a PM on this stuff

Regards,
Karen

Hi Karen,

Yes, renewing of PR is actually referring for the application for a Resident Return Visa (RRV).

Thanks for highlighting this to me. I will take note of putting links in post.

Regards,
Nancy

Default Renew / appeal for RRV to Australia for former Aussie PRs who did not live for 2 year

Hello Nancy,
Myself, my wife and 2 kids had Australian PR and unfortunately the re-entry permit expired on Aug 15 2008. I have not lived in Australia for 2 years in the last cycle of 5 years. Iam employed in Singapore and have Asiapac Management responsibility for IT of 13 countries including Australia. Can you or your firm help us make an appeal on this or other ground to apply for RRV. Will appreciate a call from you at your convenience.

Hi Rafiqul,

Please be careful about posting personal information on a open forum since anyone can see it.

Also Nancy hasn't posted on this forum for a month but we do have other agents on the forum such as Alan Collett and SOMV (Veronika) who may be able to help. You can contact them through their links in their signature.

Regards,
Karen

Question RRV (Substantial ties and compelling reasons for departure)

Hi Nancy

I am a British citizen. I lived in South Africa for the last 12 years and applied for my Australian skilled migrant visa whilst in South Africa. We spent a few days in Australia (first entry), to confirm my residence status, but never settled there. My visa expired in July 2008. I came back to the U.K instead (Sept 07),as my father was diagnosed with cancer. He is still ill. Could I provide the following information when reapplying:

Substantial ties:
1)I work for Toshiba Medical Diagnostics in the UK, who has a branch in Oz.
2)This is a business activity which may transfer technology to Oz
3)Toshiba's activities are beneficial to Oz
4)I have relatives through marriage (my wife's family?)

Compelling reasons:
5)A letter detailing his medical condition and prognosis

I'm not sure whether I am on the right track especially with regard to item 4.....Can you assist please?

Daniel Harding

Hi Daniel,

Nancy only appeared for 3 posts and then vanished - this is an old post.

There are other agents on this forum such as SOMV and Alan Collett - you can contact them through the links in their signatures.

I looked into RRV last year since I wasn't sure whether I needed one and I rang them at DIAC and found them very helpful - as it was I didn't need one.

However for an RRV I think that you must have lived in Australia for some time and it doesn't sound as if you've lived here at all (unless I mis-understood).

I would contact DIAC and see what they say....

Good luck,
Karen

Default Reapplying RRV

Hi,

I hope someone will be able to clarify this question i have.
I have a PR visa and i will be applying for RRV soon. i have been in australia for more than the required 2 years.
Assuming i have no problems acquiring the RRV, will i be allowed to keep reapplying the RRV every 5 years?
Or put it this way, is there a limited no. of times i can apply for RRV? (assuming i fulfill the required 2/5 years stay in australia)

Hi RBC:

There is no limit on the number of RRVs you can get. As long you keep eligible for RRV you may get one every 5 yrs, and the main requirement is the residence (2 out of 5 yrs).

Alternatively you may apply for AU Citizenship (this requires being in AU net for for 4 yrs), see the Citizenship website for full eligibility requirements
Citizenship

If you come from a country that allows dual citizenship this is one definite way to keep your residency in Australia active regardless of how much time you spend outside of AU.

This is the route I chose so will never need to worry about PR visas or RRV for AU again.
