But as a practical matter wouldn't you need to be in Australia to actually do a job here (I guess not an online job). So in most cases you would need an RRV to return to AU and start working.

As long as you're in AU no problem, you're a PR and you continue to be. But if outside Australia will DIAC grant that RRV now that the original RRV has expired (is there a time limit on when you can apply for an RRV?).

When you are granted permanent residency that does not expire and that allows you to work in Australia. That I don't know.

The question was actually applying via an online website which the person is allowed to do if they have PR - agreed that getting here would be another issue.

I've not had to apply for RRV so I don't know a lot about that.

Hi there,

I want to renew my PR (skill indenpendence class 880) which will be expire on July2010, since I do not fullfil the 2 years stay out of 5 years. I am thinking if I return to Australia before my PR visa expire on July2010, will I still have a chance to renew my PR for another 5 years or should I stay longer to advance to citizenship?

could anyone give me some advice please? many thanks!

hi i have 2 more questions on RRV:

does merely buying a property in australia entitle u to get an rrv based on personal ties,if yes is there any limit on min.cost of the property??

secondly when we say 2 out of 5 yrs ,does it mean 2 yrs at a stretch or cumulative 2 yrs like 3-6 months in an yr???[

Manisha,

For personal ties, each claim is handled on a case by case basis. So possibly for some people, owning a property might be enough, and for others it might not. I could even come down to which case officer is reviewing the application. I know for a fact that US Citizenship interviews depend very much on which case officer is conducting the interview. I've known people that were grilled for several hours, and others that had a pleasant chat for 10 minutes.

For the timing, 2 out of the last 5 years is a cummulative measure. If you add up all your time over the last 5 years, and achieve or exceed 2 years total, that will satisfy the criteria.

Thanks cowboy....so the safest bet is to stay for 2 yrs as other options are completely on the discretion of the case officers.[

Yes, you will have the opportunity to renew your 5 yr RRV once you've spent 2 years net out of the last 5. You can continue to stay for AU Citizenship which is 4 yrs net in AU (this would include previous times as a PR as well).

However please note that while AU can grant you Citizenship, the PRC may not recognise you as a Dual national (PRC does not recognise any dual nationality).

You should consider this before you apply for AU Citizenship.

one more question:

for the 5 yrs RRV, we have to fullfit the requirement of 2 out of 5 yrs...would they count within the PR visa validity period only? (since my PR visa will be expired 7 months later --July2010), it seems even I land today I may not have sufficient staying time for the 5yrs RRV requirement?

without a RRV means that I need to stay Australia and no travel for 4 years?

No the time spent inside can be past the last date on the original PR visa. Therefore you would be eligible for your RRV as long as you had accumulated 2 yrs out of the last 5 in AU.

The RRV mainly is so you can return to AU as a PR, but you don't lose your PR if you are resident in AU.

I know this may be stupid... how many time could I apply RRV? techincally will immigration void my PR simply they think I might not willing to stay in Australia permenently...when I apply RRV second time?
