No, as soon as you become an AU Citizen all previously held visas are automatically cancelled and therefore invalid.

From that point forward your proof for travel in and out of Australia is an Australian Passport, you are no longer a migrant once you've achieved AU Citizenship.

You should apply for an AU Passport as soon as you have officially received your Australian Citizenship (the day after the Citizenship ceremony).

You can download the necessary forms from the Passport website OR pick up an application from a Australia Post office. Then file the form in person at a local post office (call the Australia Post office to make an appointment).

Default Permanent Residency of Australia valid but not in country.

Nancy,

I have a Australian PR but it will expire in 2011. If calculated I have to return to Aus by this Aug to complete the 2 year requirement for RRV. My question is do I need to return by Aug 2009 since the PR is indefinite it is just I have to be in Aus before 2011?
PS: It will be 3 years this Aug for me after I left Aus . Hence I have lived nearly 3 years as a PR in Aus after that I am employed in a diff country.

Please let me know.

Hi Manas:

You just need to be in AU before 2011. But you can't travel outside and return to AU if you don't also have a valid RRV.

Here's what happens:
1. When you get your first PR you also get your first RRV as well and that is valid for 5 yrs. The one sticker (the PR one) serves both purposes.
2. At the end of 5 yrs you can continue to stay in AU but if you want to travel outside of AU and return as a AU PR then you need to have a RRV. This is a new Immigration sticker in your Passport

So your original RRV is valid from Aug 2006-Aug 2011, you're saying you left AU in Aug 2006? (So didn't live in AU for any significant time to build up the 2 yrs of the last 5 needed for another 5 yr RRV). If you return in Aug 2009 and then reside in AU until Aug 2011 you would fulfill the 2 yr out of last 5 + last 12 months requirement for a new 5 yr RRV. But if travel outside of AU in those 2 yrs (Aug 2009-Aug 2011) you will need to add the days to the Aug 2011 before you are eligible for your new 5 yr RRV, so if you go to a one month holiday in the time between Aug 2009-Aug 2011 then you need to be back in AU before Aug 2011 and apply for RRV at the end of Sep 2011.

You have another option as well: Apply for AU Citizenship, you can read the rules at Australian Citizenship. If you reside in AU from Aug 2009 - AUG 2013 + time spent outside of AU in that period you would probably be eligible. Once you have AU Citizenship you can travel in and out of AU on an AU passport and you never have to worry about any AU visas again, you may stay in or out of AU for any period of time.

Just make sure your original country allows dual citizenship before going down this route. Do a search on the forums as both the RRV and Citizenship have been discussed in earlier threads.

b) Ownership of a home or other major personal assets in Australia.
c) Close family members who are Australian citizens or permanent residents living in Australia.

* Evidence to demonstrate ties with Australia is assessed on a case by case basis.

1) My Aus PA is going to overdue in Feb 2010, when or how early in advance can I apply for the renewal?

2) I do not have min 2yrs stay in Aus, but I have bought a new apartment unit in Sydney last year. Will this consider as one of the criteria of personal ties (ownership of a home)? I wish to renew the PR without return back to Aus now.

Hi Nancy,

Thanks for the great info, I was looking for this and actually have post a thread asking for infor in the forum a day back.

A quick questions though does this condition for renewing the Visa applies to all visa category ( sub class) or only to the one you mentioned in your post which is subclass 155

can anyone answer regard RRV. PR visa had already expired. Do not meet 2 out of 5year requirement. Can I apply a job thru australian online recruit site.

cannot apply for RRV right or must reapply Visa Again?

Hi:

You need to get an RRV again. You can possibly get the 3 month RRV. It depends on how long it's been since your visa expired. Contact DIAC and they will tell you what you can get.

Without a visa or RRV there is no chance you can work legally in Australia.

I just rang DIAC over this one since I thought that RRV was to do with travelling and not work, and because my own PR visa expired in May and I haven't yet applied for citizenship (although I have the new book ).

Here is what I understood from the reply:
When you are granted permanent residency that does not expire and that allows you to work in Australia. As part of permanent residency you are granted the right to travel in and out of Australia and that is the document that is usually placed in your passport and that has an expiry date (usually 5 years).

RRV is when your PR travel visa has run out and you need to leave and / or return to Australia.

So maplestory if you are outside Australia then you'll need RRV to get back in (as Amaslam said) but not for work. RRV does not have anything to do with work since you have been granted PR already and so should be able to apply for jobs online.

If this is not clear I suggest you contact DIAC general help line since I've always found them very helpful.

And I'm not working here illegally - phew!
