Default Defacto 457 query...

I was wondering if anyone could shed any light on a query i have regarding our move down under. I have been offered a job and the company are going to sponsor me in Sydney, and me and my boyfriend are going to move out and hopefully include him on my application as a de facto spouse. The problem is we dont live together yet, so will struggle to prove we are a genuine couple. We now have put stuff into same adresses and getting joint accounts etc and intend to move in together in sydney.

I wondered if anyone knew if we could add him to my 457 visa at a later date when we have built up enough for the 1 year de facto rule, or will he need to be on the visa application from the start?

Thankyou in advance if anyone knows? Ive looked for similar guidance but can't seem to find out...

As far as I'm aware, your partner would have to be added to your application form when you apply, not after.

Hi there, you will ahve to say that you have lived together for at least two years. Put domestic bills and letters in your name and joint. They will want to see at least two years though. You could say that he paid all bills. If he has a tenancy contract add your name. If you ezplain to companues they are normally understanding. Good luck! Immigration are really strict on defacto, so get as much proof as you can. elisa

Thankyou for both of your thoughts, Dolly this is how i understood it as well. Its an awkward one as we dont want to go out and then risk having to come home. Ill keep hunting for some definite clarification.

Have you contacted a migration agent? They should be able to give you a definitive answer and the first consultation is usually free.

Hi bobbinational,

You could look at another option, which would be for you to apply for your 457 visa and have your boyfriend apply for a working holiday visa.

This way both of you can come to Australia at the same time, live together and build up your spouse credits (proof that you both are in a committed and caring defacto relationship). The working holiday visa is valid for 12 months and can be renewed. Once the two of you have enough proof of your defacto relationship you can then add him onto your 457 visa at a later date.

Hi Pete, That is what we were hoping to do and I have been wondering if we can.. If we can do that then we have no problems at all and like you say can build up the time together down under.. Do you happen to know if you are allowed to do that?

After speaking with the migration agents in my office yes you are allowed to do this.
