Thumbs down Warning 457 holders

Just a little warning to those of you who are on 457 Visa's or want to go on 457 (temporary visa). My husband and I have been in Sydney for over 3 years, had two kids here. After you have been in the country for two years you are allowed to apply for residency. Hubby asked the company to sponser him, this is a top international financial institution, by the way, not some fly by night company. (He was transferred over here) Next thing hubby is being made redundant. We thought everything would be ok. It took him a really long time to find another job which he eventually did, and now we have found out the reason no-one wanted to take him on was because of the length it takes to get another 457. So far he has been out of work for three months, and we are still waiting for the visa. We are really pissed off about the situation, as you can imagine with no money coming in and two kids to feed.

Anyway just wanted to say to people that as soon as you can get your permanent residency sorted out. Even if you have to go through the channels yourself. Cause you never know what is around the corner.

Hi

We were told 4-6 weeks, which we thought was rediculous seeing as we have been here so long. But last week we were told could be 14 March. No-one wants to give an exact date so we are in limbo. If I was in the possition to leave I would at this stage.

Hi, How long you can stay in OZ after your husband's last day in the first company? Officially is 28 days, but how long did your family stay before the second company sponsors your husband?

Hi,

I am in 457 visa as well, just arrived and worked in Perth for 2 months. I like here and plan to stay here with my family. May I know if I have not stay here for two years, is that possible to apply for a PR? Need some expert to advice.

Hi Adelyn:

You can apply for a Independent PR the day you arrive in AU. There is no time limit you have to be here on the 457.

The reason many wait for (2) years is after (2) years in the nominated occupation on the 457 you get to skip some of the checks/qualifications when applying for the PR (usually class 856 Employer Sponsorship). Also the 856 PR Visa requires working for the sponsoring employer for at least 12 months.

i.e. English requirement:
Employer Nomination Scheme (Subclass 121/856)

Sorry to hear that you're having trouble Byo I hope you find a solution

As for applying for PR on the 457, as amaslam says, you need to have two years of experience in that position (or something very similar). My partner and I applied for PR about 5 months after we arrived -- our only delay was waiting for our documents to arrive with our shipment -- because before he took his current position, he had been doing almost the same thing for three years in the US. So if you're able to go ahead and apply, it's a good idea.

Hi lads, Im on the verge of the same situation here nearly 2 years on a a457 and trying to make it til july so I can apply for pr before the company I work for goes bust!! Its a trying time, so fingers crossed!!!
