457 to PR. Kindly help

Thanks all this wonderful forum. I learned a lot going throw this forum in last few days then reading immi.au. Let me briefly present my case. My wife recently got sponser for 457 and i got 457 dependent visa. My wife is post graduate with 1 year of exp in speech patheologist and Myself Post graduate in Electrical engg with 4 year exp in IT sector. I am looking for the easiest way to convert from 457 to PR
1. I came to know ACS will only give approval if my exp is 4 year in IT with computer science degree. My work is embedded software which is honestly related to communication engg( A branch of Elec engg). I studied it in my bachelors and masters partly but not sure if ACS will buy my arguments
2. My job is in high demand in Oz. If my company is ready to sponser me then what option do i have and how long i need to work in that company before i can apply for PR?
3. My wife is speech pathologist who is in high demand list. She has job offer and 7.5 band IELTS. I know 175 required longer experrienc then she had so is there any other option we have?

We shall be moving by sep to OZ in 457 and want to get PR at earliest. It would be really helpful if i get some clue on how to proceed with PR.

Hi Ashish:

I did this a few years ago. You need to consider this path to PR:
Employer Nomination Scheme (Subclass 121/856)

Visa subclass 121/856

The min waiting period for this is 2 yrs with the employer, but read the links thoroughly as there are requirements for Employer and Employee.

PR is gotten within a matter of months (depending on how long various PCC/Medicals take) but I think all was said and done within 2 months of commencing processing (main wait was about 3 months before that for a PCC).

However if you don't want to use this path you may apply for a 175 PR Visa with ACS assessment as soon as you land in AU. There is no waiting period to apply for a PR when you are on another visa.

You need to have Computers degree + 4 years , other wise you should have 6 years experience for getting ACS skills done. So just come here and search for a job and complete 2 years on 457, then go for PR either from your wife employee or your own with ACS skills.

Thanks for the replies, So myself and my wife should work with 457 for 2 years and later anyone can file PR as primary applicant. I know the trouble with 457 is if job is lost then one has to exit in 28 days. To get rid of this problem:
Can i ask my employer to sponser me 457 visa saparately although i have 457 dependent visa so that if either me or my wife loses job we are in safe land since we both shall be having saparate 457 visas?
How many years of experience is required for qualification assessment as an Electrical engineering considering i have postgraduate in Elec. Engg.

I think it would be good if you also had a 457 visa for yourself as it's unlikely both of you will be unemployed at the same time. Then wait the (2) yrs and get your 856 visa at that point.

I can't really comment on the qualification assessment, but it's best to address your question to the assessment body (Engineers Australia?)

Thanks amaslam for the reply, I tried contacting so many consultant for job oppertunities sitting here in india and get feedback
  1. client only consider PR or citizens
  2. Client would consider if i were in Australia
I hope the response would be better when i shall move to aus next month. I shall contact Engineers australia and find out if its possible to get accessment for my case.

Good luck on your job search, the presence in AU will help alot as most employers are uncomfortable hiring anyone unless they've met them.

  1. Character certificate is required: Can i get this from india since its easier for me in my home country then in australia
  2. Similarly police check. Will it be ok to get it from india considering i shall be applying after 2 years for My PR?
I am asking now since i shall be travelling after a month from india and now i can get above docs if they can be used in My PR after 2 years,

Don't get them at this point. They both have a validity period of only 6 months to 1 year. It is best to get them when asked during the course of your PR application.

What you should do before you leave India is make sure your last address in India is also the same in the passport. It makes things a bit easier when you have to get your PCC.

You can apply for India PCC while you are in Australia also. You can get this PCC letter from Indian Embassy in Australia. So don't worry about PCC now.
