Default Company sponsorship

Hi All

I am new to the forum but have been in Australia for 2 years now. I have the following problem.

When you get sponsored by a company for permanent residence what do they normally pay for and what responsibilities do they have? What is the norm?

I was brought into Australia on a 457visa and was promised a permanent migration sponsorship after 2 years. Now that the 2 years is up the company have all sorts of new policies and they want me to sign a 2 year contract coming into effect after I get permanent residence status. I do not mind signing the contract as I am happy with the company. It is just that none of this was on my original contract. Also they want me to pay for everything!!

Would like to hear some comments

Hi Pieter,

Welcome to the forum.

I didn't come here on a 457 visa but my understanding from other members is that after the 2 years is up (or even before then) you have to apply for a permanent visa. If you search for 457 visa I think some members have applied for permanent residency after the 457 visa.

If your 2 years is up does that mean your visa is no longer valid? I don't know how a 457 visa works.

There are few agents on the forum and it may be worth contacting them (through the link in their signatures) to see what they say - Alan Collett, SOMV and Liana Allen.

Hi Pieter,

I'm presuming you've checked out the DIAC website for the 457 visa Temporary Business (Long Stay) - Standard Business Sponsorship (Subclass 457)

As Karen said, I'd definitely contact an agent to see what they say. From what it says on the website, sponsorship is for 2 years and the visa is between 3 months and 4 years. So surely you're up for applying for PR now?

It also states that it is the employers responsibility to "meet costs and other obligations as part of the program"

My 457 visa is valid for 4 years and originally the company commited to sponsor my permanent residence aplication after 2 years I just want to know who carried the costs when a company commits to sponsoring PR.

My problem is that originally the company commited to sponsor our PR aplication and now they are trying to get out of it by saying that we have to pay all expenses out of our own pocket. We just cannot afford to carry the full cost of the aplication and all the other related costs
The more questions we ask the more we realise that they do not really have a idea of what the whole prosess of sponsorship intails.

Also is it true that it only takes a couple of months if the company sponsors your PR aplication

which visa does the employer intend to sponsor you?

Employer Sponsored Workers
Subclass 121/856
Subclass 119/857

this is on the condition that the company cannot find local skilled people. so it is a tough call. The requirements [click here] are stringent.

These visa will get you PR
visa 457 does not give u any pr. It's a provisional visa

i didn't see anything related to the costs borne by the company. So it's how you bargain with the company I guess. You may want to check with a migration agent to be on the safe side.
The company is taking advantage of your current situation. So it is up to you how you can convince them.

Do you that in writing that the company would pay?
I would check this with an agent and see what they say...
