Hi all,

I love all the info in this forum but I have a few specific questions that I would like to ask, if anyone would be able to help it would be great

I moved to the USA in 2000 married my wife the same year (she was a US. citizen) our son was born in 2001, and in 2007 my wife passed away, since then I have been thinking about going back home to the UK, I have thought long enough and I want to move back.

so heres my Q's.

My Son, I would need to "apply for citizenship" because I cant file a right to abode, right?

also what do I need to do to move back home... as far as NHS, national insurance ect ect... 9 years from home I am not sure anymore (I left when I was 19)


Washington is a pain in the rear to get ahold of somebody that can answer my Q's.

Did you register your son's birth with the British Consulate? If so, chances are he's already all signed up as a British citizen and just needs a British passport to get back in with you. (Do keep his US passport up to date - it comes in handy sometimes.)

Not sure about the NHS and all, but someone should wander by with more information about that soon.

Your son is a US citizen courtesy of the XIVth. Your son may or may not be a British citizen depending on whether you can or cannot pass your citizenship to your son. If you were born in the UK, he certainly is. If you weren't, more information is required. Assuming he's a citizen, apply for both a Consular Report of Birth and a British passport from the embassy in Washington. The former is an extra proof and will prove invaluable should be lose his passport in the future.

As an American citizen, you should ensure he has a US passport, social security card and copy of his US birth certificate before he leaves.

Read the FAQs @ Dual Citizenship FAQ for a background on dual citizen issues from the US perspective..

If you haven't already naturalized as a USC, you should seriously consider so doing before leaving. This will preserve your right to return if you so wish.

If you're returning permanently, you have the right to use all the NHS services from day one. Simply go and sign on with a GP.

If you were living in the UK at the age of 16, you would have been issued an NI number. Info here.

Your biggest issues will probably be mundane ones such as opening a bank account and getting credit.

I was getting ready to get my US citizenship before I leave too

Only Washington does the passport and birth certificate stuff. If you need to ask a consul, the only one who appears at all useful over here is...surprisingly....the Orlando one. He's got a Facebook entry as British Consul Orlando and his name is Dean. I'd try him if you have a query.......or you can ask here. Don't waste your money on the paid telephone service -- they just read from scripts based on the website info and are generally useless

The registration of birth is a silly price but it may save your son a ton of hassle later on. Without the consular report, you son will need to prove his claim to citizenship through you every time. This gives him another avenue should the need arise.

US naturalizations are currently taking six months or less in many places. Shout if you need help.

Sorry to pester

I was wondering what the timeframe was for the registration of birth?

Also, I have been doing some digging and think I have this right,

If I register His birth, and get him a US passport, then when entering the uk I will have his registration of birth as proof so he may enter... because the US guys like to throw a fit if they see another passport. right
