Default Adjustment of Status I-485

Hi All,

I cut and pasted the following from the USCIS website, but it still is confusing so I'm wondering if anyone has any following experience of the I-485.

"One Step Process
Certain people are eligible to apply for a green card (permanent residence) while inside the United States. An immediate relative relationship allows you to apply on Form I-485, Application to Register Permanent Residence or Adjust Status, to become a permanent resident at the same time your U.S. citizen petitioner files Form I-130, Petition for Alien Relative. For more information on filing for permanent residence in one step, see our Concurrent Filing page."

My wife will be filing for me, so is this indicating I can be over on a VWP she files for the I-130 and can also apply for the I-485 whilst I'm in the US. I'd not heard this before, and that's how I'm reading it... but I've been known to misread these things

The option for spontaneous marriage requires as the term says the factor of spontaneous which is not given as you are already planning to get married. It is very thing ice even under real circumstances.

K1 or CR1 are your options. Around 6 months and receive your Green Card status after getting marreid and adjusting status in the US or around 6 months and get your Green Card status at point of entry.

You can actually adjust status from a VWP....it's been done many times successfully, and as you're a spouse, they're fairly forgiving.
The only problem is..... if you get refused, there's no appeal...their word is final, and you may incur a ban, if they think you're trying to shortcut the system.
Is it possible?? Yes.
Is it 100% safe?? No.
