Default IR1/CR1 confused and need clarification

Am I able to marry my fiancé on a holiday on an ESTA, then come back to England and await visa process? I assume that staying after the marriage to await visa process is a big no no?

I have read various links and idiot guides to visas but just want to make sure I got it right, as I have had excellent help and advise off here before.

Yes, you can enter the US, get married and return to England and then apply for the spouse visa to the US.

Upon first entering the US have your return ticket (natch!) and proof, in case the POE official asks, that you have strong ties to, and will be returning to the UK.

... and no, you cannot enter US and get married with the intention of staying in the US.

Thank you Crawford, I realise I need a return journey for the initial trip. Which is fine. I just didn't want to be doing anything dodgy or illegal or questionable.

Also the fact that I have dual nationality with Canada, I was born there, does this help my visa application at all?

I don't currently have a Canadian passport but I am able to apply for one if I need to.
