Default Just wondering......

After many false starts and trials and tribulations, we have finally managed to get all our paperwork together and file our I-130 - My husband being a US citizen and residing there with myself sitting in England. After visiting on the visa waiver programme and marrying on a whim there, we started the procedure to adjust status by instructing lawyer there. Unfortunately due to my father's ill health, I had to return to England, going over my allowed 90 days by a week or two. I am mindful that this is a drawn out process and was wondering if I am able to fly over to see my husband during this time? He has been to see me for a month but as our papers have onlly just been received - it sure seems like its going to be some time before I get to go for good. Is there anywhere I can go to research the time scale? And would my ESTA still be valid seeing as though I overstayed last time???

you can never use the visa waiver again

Can I use any other visa that is okay for me to visit - but does that take just as long? - We really didn't try to circumnavigate anything - just my dad was ill - we are still committed to me being there - but the time apart (although I could dhave been there by now with hindsight and a bit more information) seems harsh? -

you have to apply for a B-2 although you was taking a chance marrying on a visa waiver ...that is fraught with problems anyway

you apply via the london embassy I have no idea how long ...some visa are not being issued at all while the olympics is going on...... but the web site will tell you
your chances of getting it are not high

worst case scenario meet in another country

He has been over here for a month and has just gone home - are you saying that we have little chance of getting a visa at all even as a spouse - we really didn't understand the implications of what we had done - everything we did we tried to be legal about - we instructed a lawyer immediately and was informed that it would be fine for me to stay whilst I adjusted status and that is what we intended to do - If we have to wait we have to wait - such is life - but am now concerned that even if we go through the whole process we will be refused as I overstayed by two weeks ? Is that the case ?

It was a short overstay and you are the spouse of a US citizen. Unless there are more issues you should be fine as far as your spousal visa is concerned. Should!

totally no other issues - just want to make sure we are doing thing correctly - I understand the reasoning for the process - have realised that we have to take emotion out of the equation when dealing with it though
